Hiring me as your real estate photographer means that you have read and agree to the following:
This service agreement is a limited license photo release.
Images delivered are licensed to the “licensee” for:
-The purpose of listing, selling or long-term rental of a property only.
-Term of the listing.
-A primary photo can be used for a longer duration and for additional “sold” marketing materials.
-Only the licensee has permission to use the delivered images on any electronic or printed form of advertisement for the promotion of the property.
-Builders, stagers, designers, or third parties that wish to use images must contact the photographer directly for licensing and fees. Third parties are responsible for securing permission from home owner to use images.
- For image integrity, and quality control images must not be altered in any way other than cropping.
- Please contact me for an additional release for any/all printed publications that are not used to market the listing. Fees may apply.
- Images cannot/will not be made available to another agent who takes over an expired or withdrawn listing.
- Unauthorized use of images is a copyright violation, and will result in termination of this contract.
- Galleries will remain open for two weeks after delivery. They can be reopened for a fee of $10.
Copyright Notice:
- The photographer who has taken an image is the copyright holder of the image.
- Tom Godfrey Photography retains all copyrights expressed and implied otherwise for all images taken.
- Copyright is not and will not be transferred to any other party.
- Licensing may be obtained for various applications of images. Please contact me for more details.
Homeowner policy:
- Homeowners are free to download the images for personal use.
Shoot Policies
- It is the agent’s responsibility to ensure that the listing is ready for the provided services BEFORE my arrival.
- Basic edits are included. Additional edits, such as object removal, are subject to additional costs.
- For liability purposes, Tom Godfrey Photography does not handle any cleaning or moving of any objects or furniture.
- The homeowner shall ensure that there are no hazards to the photographer’s safety.
- Pets must be removed or locked away for the duration of the shoot.
Cancellations and Postponements
- It is the responsibility of the agent to inform me as soon as possible for rescheduling.
- Sessions canceled after 8pm the day before the session for any reason other than weather are liable to incur a $50 cancelation fee.
- Sessions canceled on the scheduled day will incur a $50 cancelation fee.
- Once a photographer has arrived at a property, the order may be canceled, however there will be no refund.
- Rescheduling will be subject to the photographer’s availability.
Weather Policy:
- Bad weather is frequent in New England. If there is heavy precipitation or fog forecast during your session, you may choose to reschedule with no penalty.
- Strong winds and rain limit the availability of drone usage. If conditions prohibit the scheduled use of a drone this service can be rescheduled with no penalty.
- Reschedules will be subject to availability.
Payment Policy:
- Payment is due on the day of our session.
- The photo release is not authorized until payment is received in full.
- Using images without paying for them is will be treated as copyright infringement.
-Sessions include basic edits to images. Touch-ups and heavy editing are subject to additional fees dependent on the task.
